The Federal Fair Debt Collection Practices Act (FDCPA) is a powerful statute. This law is supposed to protect you from harassment from debt collectors. Unfortunately, many collectors blatantly ignore the law. The FDCPA only applies to third party debt collectors, not original creditors. For instance, a collection agency is required to comply with the statute, but not your original credit card company. In Texas, original creditors are covered instead by the Texas Debt Collection Practices Act.
Often creditors will continue to harass you until you retain an attorney. We offer limited scope fix fee agreements that could be limited to simply sending a letter to a harassing collector. Often receiving a letter from a law firm will be all it takes for the collector to back off and comply with the law.
