Sued for Debt in Texas?

If you have been sued for a debt in Texas please understand that you are not alone. This may be the first time you have ever been sued.  There are many consumers in Texas who are sued every month for an old debt.

Unfortunately many Texas consumers make the mistake of not hiring an attorney to defend the lawsuit so they end up with a default judgment.  The debt purchasing business has gained in popularity in recent years. Debt purchasers buy portfolios of debt for as little as three to five cents on the dollar.

The purchasers then contract the debt out to local collection attorneys who file individual lawsuits against Texas Consumers. Under Texas law, they have four years to sue you for the debt under the statute of limitations.

You should do everything in your power to prevent these lawsuits from turning into judgments.  Please call me to discuss your options now.  (800) 220-4318

What can happen to me with a Credit Card Lawsuit in Texas?

1) Cloud title on your homestead property

If you own a home, a judgment can cloud title on your HOMESTEAD. In Texas your homestead is protected by the Texas Constitution from a forced sale of the property from this type of creditor however, in my experience you will have a difficult time ever selling or re-financing your homestead if a judgment is entered and no release is obtained.

2) Garnish/Freeze/Take your bank account(s)

In Texas a creditor can garnish your bank account. Many consumers confuse this with garnishing of wages, which is prohibited in Texas for most creditors. Creditors often garnish bank accounts on judgments sometimes months or years later.

3) Seize any “non-exempt” property from you

A judgment creditor in Texas can force the sale of any non-exempt property that you own.  Generally they do this with a “writ of execution.”  They send the sheriff or constable out to your property to search for non-exempt property that can be seized.

4) Put the judgment on your credit report for 10 years

A judgment is usually reported as a “public record” on your credit report similar to a Bankruptcy. Often this type of record is devastating to a credit report because bad debts are supposed to be removed from your credit report after 7 years from the final payment to the original creditor.  A judgment, however, can stay on for 10 years or more if it is renewed.

So what can you do?

  1. Fight the Lawsuit
  2. We generally charge a simple FLAT FEE to fight collection lawsuits and try to force a dismissal.  We have been successful in getting hundreds of collection lawsuits dismissed or settled for far less than what they are suing for.  We offer payment plans as described below.

  3. Debt Settlement
  4. Our firm may be able to assist in you settling this debt and other debts for a substantial reduction in what is owed.  Settlement reduces the risk of going to trial and it may improve your credit rating if the debt is currently reporting as a collection account.

  5. Bankruptcy
  6. If you qualify for Bankruptcy, it would stop the lawsuit and most likely discharge all of your credit card debt.  This is often the best solution if you anticipate multiple lawsuits on multiple debts.  A chapter 7 Bankruptcy will allow you a fresh start.

  7. Credit Repair

Our firm offers credit repair services and may be able to help restore your credit if it is being negatively impacted by this debt or other debts.  We can review your credit report and assist you by formally disputing any inaccurate information with the credit reporting agencies or with the creditor.

What are the Fees?

There is NO CHARGE to have us examine your situation and advise what the best solution may be.

After reviewing your situation we will generally quote you a FIXED FEE.  This means that you will not have to worry about paying an hourly rate and you will know exactly how much it will cost to hire us.  We also have a variety of payment plans on our fees often as low as $250.00 down and $250 per month.
