Texas City man sued over car payments
A Texas City man is being sued over claims he failed to make payments on the purchase of a vehicle.
Independent Bank filed a lawsuit March 21 in the Galveston County District Court against Andre Davis, citing breach of contract.Loan-Agreement-1633743
According to the complaint, on May 4, 2012, Davis purchased a GMC vehicle from Smart Choice Auto Group with a security interest by Independent Bank for $24,900 in 60 monthly installments.
The plaintiff says Davis failed to make payments, the bank repossessed the vehicle and sold it on Dec. 26, 2012, for less than the defendant owes.
According to the lawsuit, a deficiency balance of $21,019 remains.
Independent Bank is seeking the deficiency balance and court fees.
They are being represented in the case by attorney Monica Schulz Orlando of Orlando & Orlando LLP.
